EAU THERMALE AVÈNE CLUB SINGAPORE CUSTOMER LOYALTY PROGRAM
TERMS & CONDITIONS
1 – EAU THERMALE AVÈNE LOYALTY PROGRAM
The CLUB, Eau Thermale Avène loyalty program in Singapore has been conceived to reward Eau Thermale Avène’s valued customers (the “Member”). The Members are invited to join the Loyalty Program upon registration on the website. The Member will access the CLUB via the website to register as a Member. This allows Members to earn and accumulate points (“Reward Points”) following the purchase of at least one (1) Eau Thermale Avène product, entitling them to redeem free gifts a list of items (subject to availability) on the website and receive news and promotions information.
2 – THE CLUB MEMBERSHIP
2.1 - ELIGIBILITY
- The program is limited to individual membership only, and is limited to one (1) membership account per individual.
- Employees of Eau Thermale Avène Laboratories and its parents, subsidiaries, affiliates, and divisions, and the officers, directors, shareholders, agents, employees, representatives, associates, successors and assigns (collectively, “EA Entities”) of each such entity, are not eligible for membership benefits in the program.
- The CLUB is void where prohibited or restricted by law. Accounts are not transferable and are not for sale, resale, or barter. Eau Thermale Avène and its affiliates may also have other similar customer loyalty programs; membership in the CLUB does not confer any rights or benefits in any other programs of Eau Thermale Avène or its affiliates.
- Resident as well as non-Resident of Singapore are eligible for membership, but the eligible purchases are the ones made in Singapore only, and the redemption of products will only occur in Singapore.
2.2 – ENROLLMENT
- BY PROVIDING YOUR INFORMATION FOR PARTICIPATION IN THE PROGRAM, YOU AGREE, OR IN THE CASE OF MINOR PARTICIPANTS THE PARENT OR LEGAL GUARDIAN OF SUCH MINOR PARTICIPANT AGREES, TO BE BOUND BY THESE TERMS & CONDITIONS IN THEIR ENTIRETY.
- In order to become a member of and participate in the CLUB, the Member have to provide mandatory minimum personally identifiable information, including your first name, last name, gender, email address and a password.
2.3 – PRIVACY / DATA COLLECTION
Eau Thermale Avène and Color Play Enterprise Pte Ltd may save any data collected from its Members for an unlimited period of time after the Member’s record is first created in Eau Thermale Avène’s database records.
2.4 – PARTICIPATING STORES
All Guardian and Watsons stores distributing Eau Thermale Avène products in Singapore, excluding the E-Commerce stores.
2.5 - UNIQUE MEMBERSHIP IDENTIFIER
Members will not receive a membership card or a membership number – Member Accounts will be identified by Member email address. In order to inquire about any topic related to the CLUB or member account, the Member will have to contact by email the customer service or call the customer service on the phone line indicated in the “Contact us” field. Members may be requested to send suitable identification in order to assist with verification of account ownership and to assist with the protection and safeguarding of personal information.
2.6 - HOW TO UPDATE MEMBER INFORMATION
Members are responsible for keeping the personal information associated with their corresponding account by updating it directly in the website under the “My Registration” category available in the menu.
In the event the Member changes his/her email address, it is Member’s responsibility to inform CLUB by sending an email or call the customer Service on the phone line indicated in the “Contact us” field.
2.7 – ACCOUNT CANCELLATION
You may cancel your account/membership and participation in the CLUB at any time by contacting the customer service of CLUB. Members may be requested to send suitable identification in order to assist with verification of account ownership and to assist with the protection and safeguarding of personal information. Upon cancellation, any unused points accrued in your account will be forfeited and cannot be redeemed.
In addition, Member must comply with the general conditions set out in these terms and conditions, and should adopt a fair behavior towards Eau Thermale Avène and Color Play Enterprise Pte Ltd. Accordingly, Eau Thermale Avène reserves the right to suspend the Member account or to permanently disable an account of a Member (and therefore to cancel the benefits related to such account) by notifying the Member in the event he/she abuses the CLUB or otherwise harms Eau Thermale Avène. In such a case the Member will not be entitled to any compensation whatsoever, particularly in the following cases:
- In the event of fraud, attempted fraud or theft by the Member in any Guardian or Watsons store; or
- In the event of misuse of the CLUB by the Member; or
- In the event of conduct by the Member that is likely to disrupt the operation of the CLUB or the operation of any Eau Thermale Avène merchant outlets; or
- In the event of abnormally high number of transactions of purchases made on the same day and/or consecutive days; or
- In case of default of payment which has not been remedied by the Member within one (1) month following the notification from Eau Thermale Avène in this respect; or
- More generally, in the event of non-compliance by the Member with these terms and conditions.
3 – HOW TO EARN POINTS
3.1 - GENERAL TERMS
Members can earn CLUB Reward Points ("Reward Points") by making a qualifying purchase of Eau Thermale Avène products ("Qualifying Purchase" means all Eau Thermale Avène products distributed in Singapore by Color Play Enterprise Pte Ltd excluding promotions such as bundle packs, kits and others special promotions) at Participating Stores. Once registered as a CLUB Member (see above), you must follow the following process to register new purchases:
- Step 1: Take a picture of the EAN barcode of the Eau Thermale Avène product.
- Step 2: Take a picture of the Unique code of the Eau Thermale Avène product.
- Step 3: Take a photo of the receipt or submit all information corresponding to the purchased product such as date of purchase, Retailer type, area of purchase and store of purchase location.
Once submitted, your points will be credited to your account around 2 (two) working days after the date of purchase.
3.2 - EARNING POINTS, POINT CALCULATION AND POINTS EXPIRY
All Members will earn points when they: (i) purchase qualifying products ("Qualifying Products") at Participating Stores (i.e., make a Qualifying Purchase), AND (ii) provide visible EAN barcode scanned, unique sticker code as well as all information required, to the customer service via the website.
- They will earn ten (10) points for every 1 dollar (SGD 1) spent.
- In case of cents: one (1) point for every 1 cent (SGD 0.10) spent. For instance, if a Member spends $9.50, he/she will receive 95 points and if a Member spends $9.60, he/she will receive 96 points.
- For spend amounts that include a cent value of $0.04 or less, points earned will be rounded down to the nearest number. For instance, if a Member spends $9.84, he/she will receive 98 points.
- For spend amounts that include a cent value of $0.05 or more, points earned will be rounded up to the nearest number. For instance, if a Member spends $9.86, he/she will receive 99 points or if a Member spends $9.85, he/she will receive 99 points.
Points corresponding to the purchase of one (1) Eau Thermale Avène product will expire 365 (three hundred and sixty-five) days after the date of submission by the Member of the purchase. Member may check expiring points stated on the website.
3.3 - ACCRUAL AND CONFIRMATION OF POINTS EARNED:
Reward Points will be credited to your account in a maximum of 2 (two) working days following the time of the corresponding submission of the Qualifying Purchase.
3.4 - EXCLUSIONS
Members earn Reward Points only on the purchase of Qualifying Products at Participating Stores. Products deemed Qualifying Products are in the sole discretion of Eau Thermale Avène and Color Play Enterprise Pte Ltd. The following products, items, charges, and purchases are SPECIFICALLY EXCLUDED as Qualifying Products and/or Qualifying Purchases: promotional items such as bundle packs, kits and other promotions in kind; returned items; department store and other retailer purchases; previous purchases; shipping and handling charges. Reward Points will be earned only on the actual price of an item at the time of purchase, and not on any other original, previous, suggested retail, or manufacturer's suggested price.
The following purchases are also SPECIFICALLY UNELIGIBLE for the collection of points: (i) purchases made by a Member prior to joining the CLUB; and (ii) purchases made without first identifying and confirming your Account information. Purchases made outside Singapore are also not eligible.
3.5 - RETURNS
Reward Points earned pursuant to a Qualifying Purchase that correspond to a subsequent return, refund, returned check due to non-sufficient funds, or other credit will be deducted from the Member's account in an amount equal to the Reward Points earned for the original transaction.
3.6 - BONUS REWARD POINTS
After initial registration as a CLUB Member and confirmation of the member account, the new Member will earn 300 points and will be asked to complete full profile upon the first redemption of points.
3.7 – BIRTHDAY BONUS POINTS
Birthday bonus points will only be valid and issued out if (1) the physical actual purchase is made on the birth day itself, or (2) within the next 6 days of the birthday period. Proof of purchase (receipt of purchase) have to be present in order to validify and issue the birthday bonus points.
4 – HOW TO REDEEM REWARD POINTS
4.1 – GENERAL
Reward Points earned by a Member may be redeemed only via the website for the items available in the “Rewards Catalogue” available in the Menu. All redeemed items will be delivered to member’s address which is registered in the account. In the event that the redeemed items are not delivered successfully, a self-collection has to be made at an appointed Sing post outlet.
4.2 – REDEMPTION TERMS AND CONDITIONS
- Members will have the possibility to redeem free items only once they will have accumulated a minimum of 1,000 (three thousand) “Reward Points”.
- (4) Four levels of redemption will be available to the CLUB Member: (i) one at 300 (three hundred) points, (ii) one at 1,000 (one thousand) points, (iii) one at 3,000 (three thousand) points and lastly (iv) one at 5,000 (five thousand) points with dedicated redemption catalogues for each of these stages.
- A Member can redeem several items at the same time as long as the corresponding Reward Points are available in its account.
- The redeemed “Reward Points” will then be deducted from the Member Account balance.
- The redeemed items will be sent to the member’s address as indicated in the account within 7(seven) working days. All items for redemption are available while stocks last.
- Items will be delivered within Singapore only.
- In the event that the redeemed items are not delivered successfully due to any factor, a self-collection has to be made at an appointed Singpost outlet.
5 – OTHER TERMS & CONDITIONS / LIMITATION OF LIABILITY
5.1 - GENERAL
BY JOINING THE EAU THERMALE AVÈNE LOYALTY PROGRAM “THE CLUB”, YOU SPECIFICALLY ACKNOWLEDGE, AGREE, AND CONSENT TO BE BOUND BY THESE TERMS & CONDITIONS.
Eau Thermale Avène and Color Play Enterprise Pte Ltd reserve the right, in their sole discretion and at any time, to cancel, modify, or restrict the CLUB, in whole or in part, or any aspect of the CLUB, in whole or in part, including, without limitation, Membership eligibility requirements, the Reward Point earning/accumulation ratio, the Reward Point redemption policy, and the Reward Point expiration policy. In the event that Eau Thermale Avène or Color Play Enterprise Pte Ltd decide to terminate the CLUB, all Members will be informed by means of the contact information supplied by them. The Member will then have thirty (30) days to redeem any benefits otherwise the accumulated points will be lost. Eau Thermale Avène and Color Play Enterprise Pte Ltd may take any such action(s) without advance notice. Eau Thermale Avène and Color Play Enterprise Pte Ltd may make such changes even though such changes may affect the ability of Members, individually or collectively, to use Reward Points already accumulated. At all times, Members are solely responsible for remaining knowledgeable about, and in compliance with, these Terms & Conditions.
Eau Thermale Avène and Color Play Enterprise Pte Ltd reserve the right to determine the amount of Reward Points in any Member's account based on Eau Thermale Avène and Color Play Enterprise Pte Ltd internal records related to such Member's account. A Member's Reward Points balance, as reflected in Eau Thermale Avène and Color Play Enterprise Pte Ltd records, shall be deemed correct. In the event of an inconsistency between the amount of Reward Points accrued in a Member's account and Eau Thermale Avène and Color Play Enterprise Pte Ltd internal records, Eau Thermale Avène and Color Play Enterprise Pte Ltd internal records will control. Eau Thermale Avène and Color Play Enterprise Pte Ltd assume no responsibility for errors caused by incorrect Member information. REWARD POINTS ARE NON-TRANSFERABLE AND CANNOT BE REDEEMED FOR CASH. The transfer and/or sale of Reward Points is strictly prohibited, and may result in the confiscation or cancellation of your Reward Points as well as suspension or termination of your Membership.
Eau Thermale Avène and Color Play Enterprise Pte Ltd in their sole discretion may revoke any Member's Membership in the CLUB at any time if such Member engages in abuse of the CLUB or fails to follow the Terms & Conditions of the CLUB. Fraud or abuse relating to the accrual of Reward Points or redemption of Reward Points may result in revocation of Membership in the CLUB and may affect a Member's eligibility for participation in any other Eau Thermale Avène and Color Play Enterprise Pte Ltd program. The interpretation and application of the CLUB's Terms & Conditions are at the sole discretion and determination of Eau Thermale Avène and Color Play Enterprise Pte Ltd.
